FMCSA opens comment period on renewing the accident-register recordkeeping rule
On September 9, 2026, FMCSA published a notice in the Federal Register requesting approval to renew the information collection titled "Accident Recordkeeping Requirements" (OMB Control Number 2126-0009, Docket Number FMCSA-2026-1552). The current approval expires March 31, 2027.
The collection covers 49 CFR 390.15, which requires interstate motor carriers to maintain an accident register listing every accident, interstate and intrastate, involving their commercial motor vehicles. Carriers do not send this register to FMCSA. They must produce it when an authorized federal, state, or local official asks for it, and the record is created each time an accident occurs.
To be clear, this is a paperwork-renewal notice, not a proposed change to the rule. FMCSA is asking whether the collection is necessary, whether its burden estimate is accurate, and how the burden could be reduced. The underlying requirement to keep the register does not change as a result of this notice.
Comments must be received on or before November 9, 2026, and can be submitted through the Federal eRulemaking Portal at regulations.gov under the docket number above.

Keep a running register even if it is empty, and log every DOT-recordable accident with the date, location, driver, injuries, fatalities, and whether hazmat was released.
